1. Introduction

Welcome to Clothmaya! These Terms and Conditions (“Terms”) govern your use of our website, social media pages (collectively, the “Site”), and the purchase of any products from us. By placing an order with Clothmaya, you agree to be bound by these Terms. Please read them carefully.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our products or service without express written permission by us.

3. Products and Information Accuracy

• Colors & Images: We have made every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your device's screen will display colors with complete accuracy.

• Pricing: Prices for our products are subject to change without notice. All prices are listed in Bangladeshi Taka (BDT).

• Availability: Products are subject to availability. We reserve the right to discontinue any product at any time.

4. Ordering, Payment & Delivery Charges

Placing an order through our Site constitutes an offer to purchase our products. We reserve the right to accept or reject any order. Our payment and delivery structure is as follows:

A. For Deliveries Inside Dhaka City:

• Payment Method: Full Cash on Delivery (COD). You will pay the full order amount in cash to the delivery agent upon receiving your product.

• Delivery Charge: A flat rate of 80 BDT will be added to your total bill.

B. For Deliveries Outside Dhaka City:

• Payment Method: This is a two-part payment process.

  1. Advance Payment: You must pay 300 BDT in advance via our designated payment method (e.g., bKash, Nagad) to confirm your order. This advance payment is required before we dispatch your order.

  2. Final Payment: The remaining balance is to be paid in cash to the delivery agent upon receiving your product.

• Advance Deduction: The 300 BDT advance payment will be deducted from your final bill. For example, if your product total is 1500 BDT and the delivery charge is 150 BDT, your total bill is 1650 BDT. You will pay 300 BDT in advance and 1350 BDT to the delivery agent.

• Delivery Charge: A flat rate of 150 BDT will be added to your total bill.

• Non-Refundable Advance: The 300 BDT advance payment is non-refundable if you refuse to accept the parcel for reasons other than a product defect or an error on our part (e.g., you changed your mind).

5. Return and Complaint Policy: Mandatory On-the-Spot Inspection

PLEASE READ THIS SECTION CAREFULLY. OUR RETURN AND EXCHANGE POLICY IS STRICT AND APPLIES TO ALL CUSTOMERS.

Your satisfaction and trust are important to us. To ensure the integrity of every delivery, we have a mandatory inspection policy.

• Step 1: Inspect in Front of the Delivery Agent: It is mandatory for you to open the parcel and check the product(s) thoroughly in the presence of the delivery agent. This includes checking for:

  • The correct product, size, and color.

  • Any manufacturing defects, damage, or tears.

  • Any discrepancy from your original order.

• Step 2: Immediate Return for Issues: If you find any issue with the product (as listed above), you must refuse the parcel and return it immediately to the same delivery agent.

  • For Inside Dhaka: You will not be required to pay any charges.

  • For Outside Dhaka: If the return is due to a defect or an error by Clothmaya, your 300 BDT advance payment will be refunded to you within [e.g., 3-5 business days].

• Step 3: Final Sale After Acceptance: Once the delivery agent has left your premises, the sale is considered final and complete. No complaints, returns, or exchanges will be accepted for any reason whatsoever after this point. By paying for and accepting the delivery, you confirm that you have inspected the product and found it to be in perfect condition.

6. Intellectual Property

All content on our Site, including text, graphics, logos, images, and product designs, is the property of Clothmaya and is protected by copyright laws. Unauthorized use of this content is strictly prohibited.

7. Prohibited Uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to harass, abuse, or harm another person; (c) to infringe upon our intellectual property rights; (d) to submit false or misleading information.

8. Limitation of Liability

In no case shall Clothmaya, our directors, or employees be liable for any injury, loss, claim, or any direct, indirect, or consequential damages of any kind after the product has been inspected and accepted by you at the time of delivery, as per Section 5. Our liability is strictly limited to the point of delivery and inspection.

9. Governing Law

These Terms of Service and any agreements for services we provide you shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes will be subject to the jurisdiction of the courts of Dhaka, Bangladesh.

10. Changes to Terms & Conditions

We reserve the right to update, change, or replace any part of these Terms & Conditions by posting updates on our Site. It is your responsibility to check this page periodically for changes.
